Cinemark Mobile Messaging Terms

These Mobile Messaging (SMS) Terms (the “SMS Terms”) govern your participation in any text message or mobile messaging program (each, a “Program”) offered by Cinemark USA, Inc. and its affiliates (“Cinemark,” “we,” “us,” or “our”).
By enrolling in a Program, you agree to these SMS Terms and Cinemark’s Terms of Service and Privacy Notice, which are incorporated by reference.
1. Program Description. Cinemark may offer one or more Programs that provide recurring text messages, including:
- Promotional and marketing messages
- Personalized offers and rewards updates
- Transactional or informational alerts (e.g., account or service-related messages)
Message frequency varies depending on your interactions with Cinemark and the specific Program(s) in which you enroll.
2. Enrollment and Consent. By enrolling in a Program, you:
- Provide your express consent to receive text messages from Cinemark at the mobile number you provide
- Agree that messages may be sent using automated technology
- Acknowledge that consent is not a condition of purchase
You represent that:
- You are the account holder or have authorization to use the mobile number provided
- You will notify us of any changes to your mobile number
3. Message Frequency and Charges. Message frequency will vary. Message and data rates may apply depending on your mobile carrier and plan. You are responsible for any charges imposed by your wireless carrier.
4. Opt-Out. You may opt out of receiving text messages from a Program at any time by replying:
STOP
After you send STOP, you will receive a confirmation message, and you will no longer receive messages from that Program unless you opt in again.

6. Eligibility. Programs are intended for individuals located in the United States. You must be at least 16 years old or have parental or guardian consent. Not all mobile devices or carriers may support all Programs.
7. Carriers. Participating carriers may include, but are not limited to, AT&T, Verizon, T-Mobile, and Sprint. Carriers are not liable for delayed or undelivered messages.
8. Privacy. Your privacy is important to us. Information collected in connection with our Programs is subject to our Privacy Notice. We do not share or sell SMS opt-in data or consent information for third-party marketing purposes. We may share such information only with service providers and vendors necessary to operate and deliver the Programs (e.g., messaging platforms and carriers).
9. Changes to Programs or Terms. Cinemark may modify or discontinue a Program at any time and update these SMS Terms from time to time. Changes will be effective when posted. Your continued participation after changes constitutes acceptance of the updated SMS Terms.
10. Disclaimer of Warranties. Programs are provided on an “as-is” and “as-available” basis. We do not guarantee delivery of messages or the timeliness, accuracy, or completeness of content.
11. Limitation of Liability. To the fullest extent permitted by law, Cinemark will not be liable for delayed, undelivered, or misdirected messages; errors or omissions in message content; or any damages arising from your participation in a Program.
12. Dispute Resolution. Any disputes arising out of or relating to these SMS Terms or your participation in a Program are subject to the dispute resolution, arbitration, and class action waiver provisions set forth in Cinemark’s Terms of Service. By enrolling in a Program, you agree to be bound by those provisions.
